
Official Contest Rules
1. DESCRIPTION: NO PURCHASE NECESSARY TO ENTER OR WIN. The "Labs are Vital™ Scholarship Contest” governed by these Official Contest Rules ("Contest") begins at 12:01 AM [ET] on Monday, November 12, 2007. Submission of T-shirt design and print advertisement entries ends at 11:59 PM [ET] on Friday, March 21, 2008 ("Contest Period 1"). Submission of digital video entries ends at 11:59 PM [ET] on Friday, May 2, 2008 (Contest Period 2). The Sponsor of the contest is Labs are Vital™ ("Sponsor"). The contest prizes will be provided by The American Society for Clinical Laboratory Science (ASCLS), Blood Systems, Inc., and The Association of Public Health Laboratories (APHL). The Administrator of this Contest is Fleishman Hillard (“Contest Administrator”).
2. ELIGIBILITY: CONTEST IS OPEN TO LEGAL RESIDENTS OF THE 50 UNITED STATES AND THE DISTRICT OF COLUMBIA AND SHALL BE CONSTRUED AND EVALUATED ACCORDING TO U.S. LAW. All entrants entered into the contest must have completed at least the tenth (10th) grade or equivalent and must be registered members of the www.facebook.com Web site in compliance with Facebook’s Terms & Conditions policy located at https://register.facebook.com/terms.php for valid entry. Any individuals (including but not limited to employees, consultants, independent contractors and interns) who have, within the past six months, held employment with or performed services for Sponsor, Contest Administrator, Facebook, Inc. (“Facebook”), (collectively, "Contest Entities") or any organizations directly affiliated with the sponsorship, fulfillment, administration, prize support, advertisement or promotion of the Contest are not eligible to enter or win. Immediate family and household members of such individuals are not eligible to enter or win. "Immediate Family Members" shall mean parents, step-parents, legal guardians, children, step-children, siblings, step-siblings, or spouses. "Household Members" shall mean those people who share the same residence at least three months a year. Void where prohibited.
3. HOW TO ENTER: To enter, entrants must join the Labs are Vital Sponsored Group (“Contest Profile”) on www.facebook.com and submit an entry during the Contest Period. Follow the on-screen instructions and complete the entry form (“Entry”) by providing all of the information and/or required materials for entry into the Contest. Entry is not complete until the entrant has uploaded and attached a valid digital submission (“Submission”) to their Entry by following the onscreen prompts to attach the digital file to their entry. To be considered valid for entry:
Submissions must act to persuade a prospective student to pursue one of three potential career tracks for lab sciences: work in a clinical laboratory, public health laboratory, or a blood bank
Submissions may take the form of a print advertisement, T-shirt design or digital video
Video submissions must not exceed two minutes (120 seconds) in play length
When the form is complete, click the "Submit" button to receive one (1) entry into the Contest. All T-shirt design and print advertisement entries must be received by 11:59 PM [ET] on Friday, March 21, 2008 ("Contest Period 1"). All digital video entries must be received by 11:59 PM [ET] on Friday, May 2, 2008 (“Contest Period 2”).. Entrants are advised to retain an HD or high resolution QuickTime MOV file on a data DVD of their Submission for their own records to ensure the best viewing should their Entry be selected as the winner. The Sponsor reserves the right to disqualify any Entries or Submissions deemed inappropriate or offensive for any reason, in their sole discretion. There are no limits on the number of Entries per person, however, each Entry must meet the aforementioned requirements and be submitted separately. Each Entry can only be submitted to one (1) of the three contest categories: clinical laboratories, public health laboratories, or blood banks. Any attempt to submit an Entry to more than one of the aforementioned categories will be disqualified. Entries generated by a script, macro or other automated means will be disqualified. Each entrant must be the rightful owner (or have authorized use) of the Facebook account identified in the entrant's entry as of the closing date of either Contest Period 1 or Contest Period 2, according to the entrant’s corresponding material submission (e.g., T-shirt designs and print advertisements, or digital videos, respectively). In the event of a dispute as to the identity of a winner, the winner will be deemed to be the person in whose name the Facebook account was opened. Entrants must provide all information requested to be eligible to win. Incomplete, unreadable, or unintelligible entries will be disqualified. All information provided by entrants with their Entry becomes the property of Sponsor. Entries will not be returned or acknowledged by the Sponsor.
All submitted material (“Material”) becomes the sole property of the Sponsor. Material includes to the extent applicable (a) any information and material (e.g., video) submitted by the entrant in connection with the Contest; (b) entrant’s name, likeness, voice, and image; and (c) all photographs, recordings, audiovisual materials, writings, statements, and quotations of or by the entrant and furnished to the Sponsor by the entrant. Entrants should not submit any Material of anyone other than themselves. By submitting Material, entrants represent and warrant to the Sponsor that (i) the Material is wholly original and does not infringe upon or otherwise violate any right of any third party, (ii) entrants have all rights necessary to submit the Material in the Contest in accordance with these Official Rules, and (iii) no party other than the entrant has any right, title or interest in and to the Material or any part of the Material. Material must not contain offensive or lewd content. All tangible Material submitted will become the property of The Sponsor and will not be returned. By entering the Contest, the entrant grants The Sponsor a perpetual, fully-paid, irrevocable, non-exclusive license to reproduce, prepare derivate works of, distribute, display, exhibit, transmit, broadcast, televise, digitize, otherwise use, and permit others to use and perform throughout the world the Material in any manner, form, or format now or hereinafter created, including on the internet, and for any purpose, including, but not limited to, advertising or promotion of The Sponsor and their services, all without further consent from or payment to the entrant (or the entrant’s group). Entrants agree that The Sponsor has no obligation to post the entrant’s Material on the Labs are Vital Sponsored Group page. The Sponsor reserves the right to limit the number of entrants whose Material is posted on the Labs are Vital Sponsored Group page and to remove entrants whose entries have already been posted in the event of an error or determination that the entrant is ineligible to participate in the Contest. The entrants understand that their names and other Materials may be posted on the Labs are Vital Sponsored Group page in connection with Contest.
4. JUDGING CRITERIA: All Material submissions will be judged on the following criteria: 1) relevance to one of the specific categories; 2) ability to motivate individuals to pursue careers in the three categories of lab sciences as described above; 3) creativity/originality. All submissions will be judged by a panel of judges to be selected by the Sponsor. All decisions of the judging panel are final on all aspects of the Contest.
5a. PRIZES:
Grand Prize:
For video submissions in each of the three categories: One (1) Grand Prize winner will be selected, in each category, to receive one (1) Grand Prize package consisting of a college scholarship of $2,500.00 in U.S. currency.
For print advertisements in each of the three categories: One (1) Grand Prize winner will be selected, in each category, to receive one (1) Grand Prize package consisting of a college scholarship of $1,000.00 in U.S. currency.
For T-Shirt designs in each of the three categories: One (1) Grand Prize winner will be selected, in each category, to receive one (1) Grand Prize package Runners-Up: Nine (9) finalists (one each for video, print advertisement, and T-shirt design from each contest category) will be selected to receive one (1) Runner-Up package consisting of an Apple® iPhone (suggested retail price: $399.00)
Estimated retail value of each video grand prize is $2,500.000. Estimated retail value of each print advertisement and T-shirt design grand prize is $1,000.00. Total promotional value for each video Grand Prize: $2,500.00. Total promotional value for each Grand Prize for the print advertisement and T-shirt design contest: $1,000.00. Estimated value of each Runner-Up prize is $399.00. Total promotional value for each Runner-Up prize is $399.00. Winner will be responsible for any and all federal, state and/or local taxes resulting from acceptance of the prize. Prize winner cannot assign or transfer the prize to another person. If the prize cannot be awarded due to circumstances beyond the control of the Sponsor, a substitute prize of equal or greater retail value may be awarded; provided, however, that if prize is awarded but unclaimed/forfeited by recipient, such prize may not be re-awarded, in Sponsor’s sole discretion. Other restrictions may apply.
In order to collect any of the college scholarships, the winners must provide to the Contest Administrator proof of registration to either a college, university, community college, trade school, or any other program approved by contest administrator. If winner does not enroll in a college, university, or other qualified education program as described above within three years of notification of award, the scholarship will be forfeited.
6. WINNER SELECTION AND NOTIFICATION: Following the end of each Contest Period, the three (3) submissions for each of the different media (print advertisement and T-shirt designs (Contest Period 1) and digital videos (Contest Period 2)), in each contest category (a focus on clinical laboratory, public health laboratory or a blood bank) that most accurately reflect the aforementioned judging criteria (“Finalists”) will be selected as finalists based on the opinions of a judging panel to be selected by the Sponsor. At any time throughout the contest, the Contest Administrator and Sponsor each reserve the right to change submission dates and guidelines, without notice. This includes, but is not limited to, increasing and/or extending entry and submission deadlines for any aspect of the contest. The Finalists for Contest Period 1 will be posted on the Contest Profile from Thursday, April 3, through Tuesday, April 15 (“Voting Period for Contest Period 1”). The Finalists for Contest Period 2 will be posted on the Contest Profile from Friday, May 9, through Friday, May 23 (“Voting Period for Contest Period 2”). During this time members of the Labs are Vital Sponsored Group will be eligible to vote for their favorite Submission by logging on to the Contest Profile and following the onscreen prompts to register their vote. Only one vote per person per day will be permitted. Following the close of the Voting Period for Contest Period 1 and the Voting Period for Contest Period 2, the Submission from each category with the most votes will be named the winner. In the event that more than one Submission receives the same number of votes, then a winner will be selected from the tying entries by the Judging Panel following the guidelines of the judging criteria. Sponsor or Contest Administrator will notify winner by telephone, e-mail, overnight mail and/or via the Facebook messaging system on or about April 18, 2008 (Contest Period 1), and on or about May 26, 2008, (Contest Period 2). Selected winner will be required to respond (as directed) to the notification within fourteen (14) days of attempted notification. The failure to respond timely to the notification may result in forfeiture of the prize and, in such case, Sponsor will select an alternate winner from the pool of Finalists. Grand prize winner will be required to verify address and to execute before a notary public and return within 3 days an affidavit of eligibility and liability/publicity release covering eligibility, liability, advertising, publicity and media appearance issues, unless prohibited by law. Prize will not be awarded until all such properly executed and notarized forms are returned. In the event that a winner is a minor; all correspondence will be sent to the attention of the parent and legal guardian of such minor and the parent or legal guardian will be required to sign the affidavit of eligibility and liability/publicity release as stated above within the specified time period.
7. CONDITIONS OF PARTICIPATION/RELEASES: Contest is void where prohibited or restricted by law. All federal, state and local laws and regulations apply. By participating, entrants agree to be bound by these official rules and the decisions of the Sponsor, which shall be final in all respects. By participating in this Contest and/or by accepting any prize that they may win, entrants agree to release the Sponsor, Facebook, and Contest Administrator; their parents, subsidiaries and affiliated companies, units and divisions and advertising and promotional agencies and prize suppliers; each of their respective officers, directors, agents, representatives and employees; and each of these companies and individuals' respective successors, representatives and assigns (collectively, the "Released Parties") from any and all actions, claims, injury, loss or damage arising in any manner, directly or indirectly, from participation in this Contest and/or acceptance or use of any prize. Entrants authorize the Released Parties to use their name, voice, likeness, biographical data, city and state of residence and entry materials in programming or promotional material, worldwide in perpetuity, and/or on a winner's list, if applicable, without further permission or compensation unless prohibited by law. Sponsor is not obligated to use any of the above-mentioned information or materials, but may do so and may edit such information or materials, at Sponsor’s sole discretion, without further obligation or compensation. Without limitation to any other release of liability set forth herein, the Released Parties shall not be liable for: (i) late, lost, delayed, stolen, misdirected, postage-due, incomplete unreadable, inaccurate, garbled or unintelligible entries, communications or affidavits, regardless of the method of transmission; (ii) telephone system, telephone or computer hardware, software or other technical or computer malfunctions, lost connections, disconnections, delays or transmission errors; (iii) data corruption, theft, destruction, unauthorized access to or alteration of entry or other materials; (iv) any injuries, losses or damages of any kind caused by the prize or resulting from acceptance, possession or use of a prize, or from participation in the Contest; or (v) any printing, typographical, administrative or technological errors in any materials associated with the Contest; Sponsor and Facebook shall have no liability for damage to any computer system resulting from participating in, or accessing or downloading information in connection with this Contest, and reserve the right, in Sponsor’s sole discretion, to cancel, modify or suspend the Contest should a virus, bug, computer problem, unauthorized intervention or other causes beyond Sponsor’s control, corrupt the administration, security or proper play of the Contest. Sponsor may prohibit you from participating in the Contest or winning a prize if, in their sole discretion, they determine you are attempting to undermine the legitimate operation of the Contest by cheating, hacking, deception, or any other unfair playing practices of intending to annoy, abuse, threaten or harass any other entrants or Sponsor representatives. This Contest will be governed by the internal laws of the State of California. Any and all legal actions or claims arising in connection with this Contest must be brought in a court of competent jurisdiction within the United States. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND WILL RESULT IN DISQUALIFICATION FROM PARTICIPATION IN THE CONTEST. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR AND FACEBOOK RESERVE THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEYS’ FEES) TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
8. PRIVACY POLICY: Any personal information supplied by the entrant to Facebook will be subject to Facebook’s privacy policy posted at http://www.facebook.com/policy.php. Entrants may receive additional email communication or promotions from the Sponsor as permitted by the Facebook Terms of Service.

10. WINNERS LIST: Prize winners will be posted on the Labs Are Vital Sponsored Group page, at LabScienceCareers.com and at www.labsarevital.com on or after April 15, 2008 (for Contest Period 1), and on or after May 26, 2008 (for Contest Period 2). This offer may not be published elsewhere without the written permission of Sponsor.
